Terms of Service

Welcome to the website and professional photography services of Raj Prajapati. These Terms & Conditions explain the general terms under which photography, videography and related creative services are provided.

By confirming a project, making an advance payment, approving a quotation or engaging Raj Prajapati for photography or videography services, the client acknowledges and agrees to these terms.

Our services may include architectural photography, interior photography, hotel and resort photography, commercial photography, real estate photography, product photography, drone and aerial photography, corporate photography, videography, cinematic videos and other professional visual content.

1. Project Enquiry and Booking

Every photography project begins with a discussion of the client’s requirements. The scope, location, shoot duration, deliverables and estimated production requirements are discussed before a quotation is prepared.

A booking is considered confirmed only after the client accepts the quotation and the agreed advance payment has been received.

Tentative dates may be discussed during the enquiry stage but are not guaranteed until the booking is confirmed.

2. Scope of Work

The quotation or approved scope of work will define the services included in the project.

This may include:

• Photography
• Videography
• Drone or aerial photography and video
• Professional lighting
• Number of shoot days
• Number or type of final photographs
• Video deliverables
• Reels or social media content
• Editing and colour correction
• Other agreed production requirements

Anything not specifically mentioned in the approved quotation or scope of work should be considered outside the agreed package.

Additional requirements requested after confirmation may result in additional charges.

3. Advance Payment

A booking advance is required to reserve the shoot date and allocate production resources.

The remaining payment is payable according to the payment schedule agreed in the quotation.

For larger projects, milestone-based payments may be requested depending on the scope and duration of production.

The photographer reserves the right to hold final delivery until outstanding payments have been cleared.

4. Shoot Date and Rescheduling

Shoot dates are reserved specifically for the client.

If the client requests a change of date, reasonable notice should be provided. Rescheduling is subject to the photographer’s availability and may not always be possible.

For projects involving travel, accommodation, hired crew, equipment or other third-party arrangements, additional cancellation or rescheduling costs may apply.

Weather-dependent photography, particularly drone and exterior photography, may need to be rescheduled when weather conditions are unsuitable or unsafe.

5. Client Responsibilities

The client is responsible for ensuring that the location is ready for photography on the agreed shoot date.

Depending on the project, this may include:

• Cleaning and preparing the location
• Completing necessary maintenance
• Removing unwanted objects
• Arranging furniture and décor
• Ensuring access to all required areas
• Providing electricity and suitable working conditions
• Arranging permissions where required
• Ensuring staff or representatives are available when necessary
• Providing accurate project information

Delays caused by location readiness, access restrictions, staff availability or client-side requirements may affect the shooting schedule and delivery timeline.

6. Hotel, Resort and Property Photography

For hotel, resort, real estate and architectural projects, the property should be properly prepared before the photographer arrives.

Rooms, public areas, landscaping, restaurants, facilities and other spaces should be clean, maintained and ready for photography.

Unless specifically included in the quotation, professional styling, floristry, décor, models, food styling, housekeeping, set design and other specialist services are not included.

7. Guest and Personal Photography

For hotel, resort, residential and commercial projects, photography of guests, visitors, employees or other identifiable individuals is not included unless specifically agreed in advance.

The client is responsible for obtaining any necessary permissions or releases for people appearing in the photographs or videos.

8. Drone Photography and Videography

Drone services are subject to weather conditions, airspace restrictions, local regulations, permissions and operational safety.

Drone photography or video may need to be cancelled or rescheduled if safe operation is not possible.

The photographer will make reasonable efforts to conduct approved drone operations but cannot guarantee aerial shooting where legal, regulatory, weather or safety restrictions prevent operation.

9. Editing and Post-Production

Professional editing and colour correction are included according to the agreed scope.

Normal post-production may include:

• Exposure and colour correction
• White balance correction
• Perspective correction
• Image cropping
• Basic object cleanup
• Colour grading for video
• Basic video editing where included

Major retouching, extensive object removal, compositing, VFX, 3D work, advanced graphic design or substantial changes to the original scene are not included unless specifically agreed.

10. Delivery Timeline

The estimated delivery time will depend on the project size, number of photographs, video requirements and editing complexity.

Typical timelines will be communicated at the time of booking.

Delivery timelines may change when the project requires extensive editing, revisions, additional approvals or information from the client.

11. Revisions

Where revisions are included, they will be limited to the scope agreed in the quotation.

Revision requests should be consolidated and communicated clearly.

Major changes to an approved concept, edit or deliverable may be treated as additional work and charged separately.

12. Raw Files

Raw photographs, camera files and original project files are not automatically included in standard photography packages.

Raw files may be provided only when specifically mentioned in the quotation or separately agreed with the client.

13. Travel, Accommodation and Expenses

For assignments outside the agreed local service area, travel, accommodation, food, transportation, permits, parking and other project-related expenses may be charged separately unless specifically included in the quotation.

Where these expenses are included, the scope of inclusion will be mentioned in the quotation.

14. Cancellation

Cancellation of a confirmed project may result in loss of the booking advance because the shoot date and production resources have been reserved for the client.

Where significant production costs have already been incurred, those costs may also be payable by the client.

The exact cancellation terms may vary depending on the project and will be communicated in the quotation where applicable.

15. Copyright and Usage

Unless otherwise agreed in writing, the photographer retains copyright in the photographs and creative work produced.

The client’s usage rights will depend on the scope and purpose agreed at the time of booking.

Commercial campaigns, advertising, publication, social media, website use, editorial use and other forms of usage may be subject to different licensing arrangements.

If the client requires exclusive ownership or specific usage rights, these should be discussed before the project is confirmed.

16. Portfolio and Promotional Use

Unless the client requests otherwise in writing before the project is delivered, Raj Prajapati may use selected photographs or videos created during a project for professional portfolio, website, social media, awards, presentations and promotional purposes.

Confidential, unreleased or restricted projects will be handled according to the client’s agreed confidentiality requirements.

17. Force Majeure

Raj Prajapati will not be responsible for delays or inability to perform services caused by circumstances outside reasonable control, including severe weather, natural disasters, government restrictions, transport disruptions, accidents, technical failures, illness or other unforeseen circumstances.

Reasonable efforts will be made to reschedule or find an appropriate solution.

18. Agreement

By confirming a photography or videography assignment, the client confirms that they have reviewed and accepted these Terms & Conditions along with the agreed quotation or scope of work.

Project-specific terms mentioned in an approved quotation may take precedence over general terms where the two differ.
